Agreed. I'd think you should be covered by your insurance. If they think it is someone else's liability they should pursue that party.

Don't be so sure they will pay..... PROPERTY Insurance is both under-understood and sold misleadingly giving a false euphorbium of safety and protection. You feel good at premium time and at times of need you get the SHAFT! Insurance will claim they can't control "natural disasters" that hurt your neighbor's property and water control attempts that damaged yours and you won't get even a flying turd of consideration from them as far as help or compensation, and they will tell you to go after you neighbor with lawyers yourself.
